This Agreement is an enforceable agreement between you and vivo Mobile Communication Co., Ltd. (hereinafter referred to as "vivo", "we", "us", or "our") regarding your use of the Origin Notes service (hereinafter referred to as "this Service"). You have the right to decide not to use this Service. However, the terms of this Agreement are inseparable from this Service. By using this Service, you agree to be bound by the terms of this Agreement. Please be sure to carefully read and fully understand the terms of service and privacy statement of the internet service providers, especially the disclaimer or limitation of liability clauses, as well as any other further agreements governing the enabling and use of a particular service, and choose either to accept or reject them. Please note that disclaimer and limitation of liability clauses may be in bold lettering for your attention. Before using this Service, minors should read and understand the rules of this Service together with their guardian and obtain their consent.

Note: The features available in this Service may vary across device and operating system versions. Some of the features listed below may be temporarily unavailable on specific devices, subject to the system version of your device. All rules regarding information collection and usage are applicable only to the features available to you. For example, if the Optical Character Recognition (OCR) feature is not available to the system version of your device, you will not be able to use the feature on your device or app. Moreover, we will not collect or use information and data related to this feature.

1. Service content
Notes management: You can edit images and text or import existing files to create notes as well as modify existing notes.
Doc management: You can view, create, and modify your documents.
To-do: Jot down your to-do items at any time to help make your life and work more organized and efficient.
Doc scan: Scan a document to recognize and extract its content.
Doodle: You can capture your ideas and draw anything you want as well as search and locate content in your doodles.
Table: Record your data in an intuitive and visualized manner.
Dictation: You can generate text and voice notes through dictation.
Data sync: To avoid loss of your notes due to accidental deletion or replacing your device, you can use data sync to back up your data to the cloud, so you can retrieve your local data when needed.
OCR: Using this feature, you can scan an image to recognize and extract text to add to your notes.
AI creation of notes: This feature allows you to select text in a note to intelligently modify the content of the note or continue creation. Alternatively, you can select template instructions or custom instructions to automatically generate relevant content in the note.

2. Rights and obligations
2.1 vivo grants you a non-commercial and non-exclusive license to use this Service in the Chinese mainland. You have no right to sub-license this Service. You shall not attempt to decompile, reverse-engineer, or otherwise damage the integrity of this software, and shall not use this software to conduct any acts in violation of laws and regulations.
2.2 For the dictation service, when you tap the Dictation button and trigger dictation, we will upload the relevant audio to the server to recognize the audio content and display the converted text on the current dictation screen. If Also Save Audio is enabled, your audio messages will be saved on your intelligent terminal device. If Automatically Add Location Information is enabled, your location information will also be displayed on the current page. The location information in this Service will not be collected or uploaded to our server. None of the uploaded audio messages will be stored on the server after parsing is completed.
2.3 The data sync service requires you to upload the information you want to sync to the cloud. When enabled, data will be synced in real time to save you the trouble of manually syncing data. If you do not want to sync data, you can go to Origin Notes > Me to disable Auto-sync Origin Notes.

3. Important notes
3.1 You understand and agree that Origin Notes serves as a recording tool to help you track and manage events in your life quickly and easily. Origin Notes cannot act as actual event reminders and plans. During the use of this Service, please set reminders for important events, and prioritize those events by urgency and importance to better schedule and manage your life.
3.2 For the Origin Notes service feature, please understand that we will provide you with services within the current scope of technical capabilities. We will try our best to improve your user experience, but the text information converted from audio or analyzed from pages may still be different from your expectations. We make no guarantees about the accuracy or applicability of the converted results. Please make sure to double check the converted information and correct any potential errors to improve the accuracy of the information recorded.
3.3 Please note that the data sync service requires you to sign in to your vivo account and your data will be stored in vivoCloud. You must use your vivo account in compliance with laws and regulations as well as our rules for using vivo accounts. If your account is canceled (whether it is cancellation at your request or forced cancellation), the content and assets under your cloud service account will be cleared. Please back up your data in advance to avoid any loss of data due to account cancellation.
3.4 You understand and agree that you must be responsible for all acts under your account during the use of this Service, including any content you may publish and any consequences arising therefrom. Please do not use the Origin Notes service to conduct any acts in violation of laws and regulations. You should exercise discretion when judging the content of the Service, and assume all risks arising from the use of the content, including any reliance on its legitimacy, correctness, integrity, or applicability. vivo cannot and will not be responsible for any losses or damages caused by the foregoing risks.
3.5. vivo does not make any representations or warranties, whether express or implied, including representations and warranties regarding the effectiveness, accuracy, integrity, merchantability, applicability of special purposes, and non-infringement, as well as those regarding the following circumstances:
(1) This Service will satisfy your specific needs.
(2) This Service will be provided in a non-stop, timely, and secure manner without any faults.
(3) All the information you obtain from using this Service is correct or reliable.
(4) Any faults or errors as part of this Service will be fixed. vivo has no control over your network carrier and therefore makes no guarantees regarding the carrier's network coverage, availability, or service quality.
3.6 Specification for identifying generated synthetic content
In accordance with applicable laws and regulations, we include identifiers in generated synthetic content. These identifiers may be either explicit (clearly visible to users) or implicit (not easily perceived by users). When using this Service, you must comply with the following requirements:
(1) It is prohibited to delete, tamper with, falsify, or hide any of the above-mentioned identifiers, and it is also prohibited to provide others with tools or services for such purpose.
(2) When you publish AI-generated content on online platforms, you must clearly disclose that the content was generated by artificial intelligence, and properly label it by using the appropriate functions provided by the platforms.

4. User privacy protection
vivo respects your privacy and personal data and will do our best to protect your privacy and personal data during your use of this Service. For details about the information collection and protection rules of this Service, please refer to the Origin Notes Privacy Policy.

5. Term of the Agreement
This Agreement takes effect upon your consent to the content herein, and will automatically terminate under any of the following circumstances:
(1) The user does not comply with this Agreement when using the software, and such non-compliant use has not been corrected within the exhortation period or after 15 days;
(2) Either contracted party is disqualified from performing this Agreement;
(3) Force majeure makes it difficult for either contracted party to perform their obligations;
(4) Both contracted parties agree to terminate this Agreement.

6. Applicable laws and jurisdiction
Unless otherwise specified by the laws of the region where you are located, this Agreement shall be governed by and interpreted in accordance with the laws of the People's Republic of China, without regard to conflict of laws principles. Any dispute arising between the two parties regarding this Service shall be settled through friendly negotiations. In the case that negotiation fails, the dispute can be submitted to the court of jurisdiction at the signing location of this Agreement in Chang'an town, Dongguan city. If, for any reason, the court of competent jurisdiction holds that any terms or part of the terms herein cannot be enforced, the rest of this Agreement will remain in full force.

7. Updates to the Agreement
vivo reserves the right to update or modify this Agreement from time to time. When this Agreement is changed or modified, vivo shall notify you of the changes and/or modifications as well as the path for viewing them in pop-up windows, push notifications, or other prominent prompts to remind you of any changes or modifications to this Agreement.
