This Privacy Policy applies to the Music product and service (hereinafter referred to as "this Product") provided by Guangdong Tianchen Network Technology Co., Ltd. and its affiliates (hereinafter referred to as "we", "us", or "our").Please make sure to read this Policy carefully (text in bold in particular) and understand how we process your personal information. Use our product and service only after you have fully understood and agreed to the terms herein. If you/your guardians do not agree to any part of this Privacy Policy, you should immediately stop using this service. By starting to use it, you/your guardians agree to our collection, storage, use, sharing, and protection of your personal information in accordance with this policy.


   This Policy mainly includes the following content:

1.The scope, purposes, and methods of personal information collection for the services and functions of this Product. We shall collect your personal information in strict accordance with relevant laws and regulations. If you refuse to provide some information, your use of some services might be affected.

2.The phone permissions this Product might need to request and the purposes for the request. You can disable permissions in your phone settings at any time. Your agreement to this Policy does not mean that the permissions will be enabled by default.

3.This Policy might be updated and we will inform you of the updates according to the method specified in this Policy. If our collection and use of your personal information goes beyond the scope specified by this Policy, we will also inform you and obtain your permission.

1. How we collect and use your personal information

1.1 Display, playback, and download of audio and videos: We need to collect the browse and playback history as well as favorites during your use of the audio/video display and playback services. If you use this Product to implement the local music feature, we also need to obtain the local music information in your device (such as local music list and local music playback information)to show you and facilitate you to view and play local music. When you use the video-to-song service, we need to read the video files in your device to provide you with the video-to-song service. When you use immersive mode, we need to read the image and video files in your device to play the images and videos you selected in immersive mode. We only process your music, videos, and images files locally on the device.

1.2 Search services: We need to collect your search content, browse history and time, search time, and number of interactions to provide you the content you need and services you might be interested in.

1.3 Account services: Music provides account sign-in and usage services. When you use your vivo account to sign in, favorite content that you are interested in, and purchase products and services, we will obtain your account information (such as account nickname, profile picture, and OpenID), favorites history, order information (such as order number, recipient information, product and service purchase information, etc.), and other account-related information to provide the services. In the case that a transaction is refunded, we will also need to obtain your payment account information. You can also choose to complete your personal data in personal settings. We will use the aforementioned information to match and recommend music, audiobooks, and videos you might like to provide you with personalized content recommendation services.

1.4 Display and recommendation of voucher information: We will collect your account information, device information (device identifier, model, system version, and system language), initial activation channel and usage time, app version, product ID, taps and exposure of each page, and error messages. The data collected is mainly used to display product and voucher information in a way that can better satisfy your interests and keep improving and optimizing our services and functions.

1.5 Product updates: Music requires a connection to the server to perform updates. To check for updates, you need to provide the software version, device identifier, model information, and system version. After you launch Music and connect to the internet, Music will communicate with the vivo server regularly to check for the latest version available. When a new version is found, we will prompt you to perform one of three actions: update, download and install, or confirm before updating. Updates will help fix bugs of previous versions and improve our services and your experience.

1.6 Troubleshooting: By uploading and analyzing the log information you have submitted or identified, we can help address the issues you encounter during your use of Music. If you contact us to submit error feedback, we may also obtain your contact information to contact you and help you fix the issues.

1.7 Network security: To ensure the normal operation of the services, we might automatically collect and store information about the services you use and how you use them in a way that associates with you. Such information includes log information, device-related information, and network information. Log information refers to mainly the details regarding your use of our services, such as sign-in account, search content, IP addresses, network environment, and access records. Device information mainly includes the IMEI, IMSI, MEID, Android ID, MAC address, eMMC ID, serial number, UFS ID, ICCID, device model, and supplementary identifiers (such as the VAID, AAID, and OAID); network information includes the network connection status (2G, 3G, 4G, 5G, or Wi-Fi). Such information is used to provide personalized content (which may include ads). You can close this app or disconnect from the network to terminate data collection and uploading.

1.8 To enable song recognition, which is provided by Beijing Wendong Information Technology Co., Ltd. (ACRCloud) and Tencent Music Entertainment Technology (Shenzhen) Co., Ltd. (QQ Music), your uploaded recordings will be sent to servers of Beijing Wendong Information Technology Co., Ltd. (ACRCloud) and Tencent Music Entertainment Technology (Shenzhen) Co., Ltd. (QQ Music) for processing.

1.9 When you share songs, playlists, albums, audiobooks, lyrics, or other content, we need to obtain the list of apps you have installed, so that you can use the Share button to share certain service content to a third-party service.

1.10 Top-up, purchase, and payment services: When you purchase content in Music, we will collect your purchase history in order to provide you with your transaction history and protect your virtual resources to the greatest extent possible.

1.11 vivo Fan Card: When you use the vivo Fan Card service, we will collect your ICCID to identify your vivo Fan Card and provide you with free data.

1.12 Apart from the usage scenarios listed above, your personal information may also be used for the following purposes:

(1) We may combine the information for all services of this Product to create feature models and personas so as to provide you with more personalized and convenient services. We may collect your account information (OpenID), online actions (playback history and favorites), and other information, for data analysis (including but not limited to the creation of data analysis models) so that we can create personas to display the product or service information of interest to you. Such information is displayed in the Featured section on the homepage. You can go to Me > Settings > Accounts, messages and personalization > Messages & personalization > Feeds recommended or Ad recommendation to opt out of receiving personalized content. With the option turned off, we will not collect or use your personal information to personalize the content shown to you. Opting out may not prevent you from seeing recommended content based on factors other than your personal information.

(2) The information we collect will not identify you, but will only be used as the database for the R&D and promotion of existing or new products and services.

(3) We may collect the usage information about the services or functions related to this Product and share such information with the public or third parties in a way that will not associate with or identify you.

1.13 Under the following circumstances, we may collect and use your personal information without your prior consent:

(1) The personal information is directly related to national security and national defense;

(2) The personal information is directly related to public safety, public health, and major public interests;

(3) The personal information is directly related to criminal investigation, prosecution, trial, and execution of sentences;

(4) The personal information is required to protect the life, property, and other major legitimate rights and interests of you or any other individual, where it is difficult to obtain your consent;

(5) The personal information has been disclosed to the public by yourself;

(6) Personal information which is collected from legally disclosed information, such as legal news reports, government information disclosures, etc.;

(7) Other circumstances as stipulated by laws and regulations.

1.14 Miscellaneous

Please note that this Service is being constantly updated and developed. If you choose to use any other service than what is described above, we will inform you of the scope and purpose of information collection through page prompts, interactive processes, or agreements and obtain your consent depending on the information we need to collect from you for such service. We shall use, store, disclose, and protect your information in accordance with this Policy as well as relevant user agreement. If you choose not to provide the aforementioned information, you may not be able to use some services or part of a service, but this will not affect your use of the other services we provide. In addition, third parties may provide services for you through Music. When you access the service page operated by a third party, please note that relevant services are provided by such third party. Regarding the collection of your personal information by third parties, please carefully read their privacy policies or relevant agreements.

2. The phone permissions we need to request

Below are the permission types and service functions we need to request as well as how to disable such permissions. When providing services, we may request the following permissions:

(1) Phone (access to the IMEI): We will request your phone permission in order to identify you.

(2) Storage (read and write access to storage): This app requires access to your device's storage to store your favorites, browsing history, and other information.

(3) Microphone: When you use the song recognition service, we need to request the microphone permission to collect the song information or your voice commands. If you deny our access to this permission, you will not be able to use the above functions, but your use of other services of Music will not be affected.

(4) Location (approximate location): We need to access your approximate location to determine the relative location of networking devices. If you deny our access to this permission, the positioning of the "Local Station" service might not be accurate, but your use of other services of Music will not be affected.

(5) Camera: When you create lyric posters and change your profile picture, we need to use your phone's camera to shoot and post photos.

To withdraw your authorization for the aforementioned permissions, you can search for "Permission management" in Settings, locate relevant permissions for Music, and disable them. After that, we will no longer obtain these permissions, but this may affect your use of features or services requiring such permissions.

3. How we share your personal information

We will only share your personal information under the following circumstances:

(1) Sharing with specified third parties: With your explicit consent, we will share your personal information with the specified third party within the scope of your authorization.

(2) Sharing with specific organizations as required by law: In compliance with applicable laws and regulations, we may be required to share your personal information to aid in investigative processes.

(3) Share with business partners: When you choose the services jointly provided by us and our business partners, to ensure the services work properly, we will share your personal information with our business partners on a legitimate, reasonable, and necessary basis. Our partners may include providers of various search services, providers of prize redemption services, third-party shopping platforms, content providers, providers of ad analysis services, etc. To implement relevant features of Music and ensure the secure and stable operation of the app, we may integrate some software development kits (SDKs) provided by third parties. We will closely monitor the security of SDKs used by our partners for information collection so as to protect your data.

(4) Share with business security stakeholders: In order to maintain business security and control operation risks, we will share relevant account usage information with our stakeholders.

4.How we protect minors' personal information

We pay special attention to protecting the privacy of minors and advocate that parents or guardians pay attention to the activities and hobbies of minors. (The age of minors is determined by local laws and cultural practices where you reside.) We do not target minors as users. We will not deliberately collect the data of minors. If you find that the personal data of a minor in your care has been collected without your consent, please contact us to delete it and make sure that the minor unsubscribes from relevant services. Without the guardian's consent, we shall not collect or use the information of minors, nor shall we provide personalized display for minors.

5.How we store your personal information

5.1 Retention period: We will store your personal information consistently during your use of this Product. When you request to delete your personal information or cancel your account, we will retain your existing personal information for the minimum period specified by applicable laws and regulations. During this period, your personal information will not be used for any other purposes unless as permitted by laws and regulations. After this period, we will anonymize such information.

5.2 Storage location: Your personal information will be stored and used in the Chinese mainland.

6.Execution of the rights to manage your personal information

6.1 Query, modification, and deletion

You can request to query, modify, and delete your personal information via the following contact information. In order to better protect the security of users' personal information, we may verify your identity before accepting any request to ensure that it is initiated by the personal information subject or their authorized person. Meanwhile, please ensure that your request is specific and implementable. We will try our best to carry out accepted requests within a reasonable period of time.

Please understand that your request may not be accepted under the following circumstances, and we will inform you of the reason therefor:

(1) You are not the subject of the personal information or your identity as the rights holder cannot be authenticated.

(2) Your request goes beyond the scope of your rights, or you have submitted a duplicate request.

(3) The related information disclosure may damage our interests.

(4) The information retained is for the purpose of statistics and research only, and the disclosure of the statistics and research results will not identify you.

(5) Other circumstances as stipulated by law.

6.2 Withdrawal of consent

You may request withdrawal of your consent via our customer service number at 95033 to change the scope of your authorization for us to continue collecting your personal information or withdraw your authorization. Please understand that the performance of each feature requires certain basic personal information. After you withdraw your consent or authorization, we will no longer be able to provide you with the related services, nor will we process your relevant personal information. However, your decision to withdraw your consent or authorization will not affect the processing of personal information previously conducted based on your authorization.

6.3 Account cancellation

To cancel the account for this Product, you can go to Me, tap your profile picture, and then tap vivo Account > Security Center Privacy Settings. However, account cancellation may lead to the unavailability of the services and loss of data and relevant virtual assets. Please confirm that you are aware of the consequences and proceed with caution.

7.How we update this Policy

Please understand that the features and services we provide are constantly being updated and developed. If one feature or service is not listed above and requires your information, we will inform you of the content, scope, and purposes of the information to be collected via page prompts, interactive procedures, website notices, separate agreements, etc. to obtain your consent.

8.Third-party websites and services

Depending on the Music products or services you use, some third-party products or services may be included, such as redemption of vouchers, search services, song services, audiobook services, live streaming services, song recognition, etc., which may be provided in the form of third-party website links, SDKs, APIs, etc. When you use such products or services, we need to share your personal information (such as device information and usage behavior data) with the aforementioned third-party partners. When sharing the information, we will ask the third parties to use your information within the specified scope and in accordance with laws and regulations. Please also read the third party's privacy policy to learn their rules on information collection.

1. If you have any questions, comments, or suggestions, please call our customer service at 95033, or go to Music > Settings > Help and Feedback to contact us via our online service agents. We will reply with a reasonable explanation within 15 days after verifying your identity.

2. To make sure that we can handle your queries efficiently and provide timely feedback, in some cases, we may ask you to submit proof of identity, valid contact information, a written request, and relevant evidence. We will process your request after verifying your identity.

3. If you are not satisfied with our reply or handling, you can turn to external approaches by submitting a request to the Dongguan No. 2 People's Court in Guangdong Province, China.
